Section 179A Notice - Chapel Lane, Cootehill
Notice of Intention to undertake Development by a Local Authority under Section 179A of the Planning and Development Act, 2000 (as amended)
In accordance with the provisions of Section 179A of the Planning and Development Act 2000 (as amended) Cavan County Council gives notice of its intention to carry out the following development:
- Construction of 13 No. fully serviced dwelling units in 1 terrace block consisting of 9 no. 1 bed maisonettes, 1 no. 2 bed maisonette and 3 no. 3 bed two storey townhouses, provide car parking, connect to existing public services and all ancillary and associated works at Chapel Lane, Munnilly, Cootehill, Co. Cavan.
The development has been the subject of an Appropriate Assessment screening in accordance with Article 6(3) of the EU Habitats Directive (Directive 92/43/EEC) and Article 250(1) of the Planning and Development Regulations 2022, as amended. The Appropriate Assessment screening concluded that the proposed development would not be likely to give rise to significant or indeterminate impacts on any Natura 2000 site.
The project is approved for funding from the Department of Housing, Planning and Local Government and forms a key part of Cavan County Councils Housing Strategy to deliver new build homes in Co. Cavan.
Plans and particulars of the proposed development, include copies of the AA screenings and determinations, will be available for inspection and/or purchase at a fee not exceeding the reasonable cost of making a copy at the following locations during normal working hours:
- Customer Service Desk, Johnston Library, Farnham Street, Cavan, Co. Cavan (online viewing)
- Cootehill Bailieborough Municipal District Office, The Court House, Market St, Magheranure, Cootehill, Co. Cavan

A person may question the validity of any decision of the planning authority by way of an application for judicial review, under Order 84 of the Rules of the Superior Courts (S.I. No. 15 of 1986), in accordance with sections 50 and 50A of the Planning and Development Act 2000, as amended.
It is proposed to commence the housing development not earlier than eight weeks from the date of this notice.
